Membership Agreement
Welcome to the BOLT Fitness Community.
Please take the time to read through the Terms and Conditions of your Membership Agreement. Please ensure you clearly understand our Terms and Conditions before signing this document.
All signed Terms and Conditions will indicate you fully understand all conditions.
1. Your BOLT Health and Fitness Pty Ltd Agreement Duration and Automatic Renewal
Your agreement is on a month-to-month basis from the date you sign this document, with automatic renewal, unless you cancel using the BOLT Fitness Cancellation Form, which can be requested from the admin team.
Please note any weeks spent on suspension do not count towards your minimum term.
2. Definitions

Agreement means this membership agreement between you and BOLT Health and Fitness Pty Ltd.

Billing Account means the bank account or credit card from which you want your direct debit Membership Fees deducted.

Commitment Fee means the initial Fee specified in the Agreement.

BOLT Health and Fitness Etiquette means the BOLT Health and Fitness Pty Ltd rules, as amended from time to time, located within the facility, and these terms and conditions.

Direct Debit (DD) Membership means your weekly/fortnightly membership rate as agreed by you, with recurring weekly/fortnightly direct debit payments.

The DD Membership Fee is the weekly/fortnightly fee payable for the DD Membership, exclusive of any Payment Provider fees.

Dishonor Fee is a $15.00 fee that the payment processing company charges for all missed/failed payments.

Pre-session screening means completing the pre-exercise questionnaire and liability waiver before using BOLT Health and Fitness Pty Ltd.
-
BOLT Health and Fitness Pty Ltd means the entity specified in your Membership Agreement and includes its heirs, estates, agents, representatives, officers, directors, shareholders, successors, affiliates, subsidiaries, and employees.

Member means the individual who has entered into this Agreement with BOLT Health and Fitness Pty Ltd.

Member Profile means the details you provided to BOLT Health and Fitness Pty Ltd (e.g., name, address, payment card details) relating to your membership.

Membership Fees means the fees that are due and payable by you under this Agreement.

Minor means members under the age of 18.

Payment Agreement means the Agreement between you and us permitting our Payment Provider to provide the direct debit and credit card payment facilities to you on our behalf in accordance with the Payment Provider’s Direct Debit Service Agreement.

Payment Provider means the payment provider specified by BOLT Fitness Pty Ltd (Stripe/Integrapay) unless otherwise specified.

Policies mean the BOLT Health and Fitness Pty Ltd membership policies, which are available at the facility on request and amended occasionally.

Products are any products purchased under BOLT Health and Fitness Pty Ltd sale of goods terms and conditions.

Opening Hours refer to the facility's operating hours, which are located within the studio. BOLT Health and Fitness Pty Ltd reserves the right to change the Opening Hours at any time without notice.

Written Notice means notice in writing, given in person, by email or post to the parties’ last known address.
3. Membership
Your membership at BOLT Health and Fitness Pty Ltd entitles you to use BOLT Health and Fitness Pty Ltd services as detailed in your membership type.
All members are entitled to:

Use and access to change rooms, restrooms, and training equipment.

If you would like to use our Body Scanner, the charge is $25.00 per scan.
Your chosen Membership type:
The Member agrees to a month-to-month membership with unlimited access to all classes offered by the Gym at the rate specified in your agreement.
Support Services
As part of this membership, the Gym will provide:

Regular consultations to support your fitness and health goals

Ongoing nutrition guidance
-
Personalized training support throughout your membership journey

It is your responsibility to provide BOLT Health and Fitness Pty Ltd with any change of personal details relevant to your membership in writing.

BOLT Health and Fitness Pty Ltd reserves the right to terminate your membership.

Please note that all failed payments will incur a $15 missed payment (re-processing) fee charged by the payment processing company. You will be notified in writing that this will be added to your next debit.

Payments cannot be refunded, nor can credit be applied if you don’t attend the facility/sessions as all payments are processed on the agreed date for the week ahead by the payment processing company.
4. Studio Closure
-
We may need to close the BOLT Fitness training studio for a period of time, for example, due to an emergency or if required by court or by law.

We may close the BOLT Fitness training studio for any period under clause 4 and continue charging Membership Fees. We will continue charging Membership Fees and transition the training to our Online platform.
5. BOLT Health and Fitness Pty Ltd Etiquette

Training Gear
-
Appropriate training shoes must be worn at all times.
-
Clothing must be clean and odour-free
-
A t-shirt or singlet must be worn at all times.
-
No Jeans, No Boots, No Thongs
-

Towel
-
Please have one at all times. No towel, no training.

Please place a towel over equipment where possible during use
-

Change rooms
-
Treat them as if they were your own
-
Notify us ASAP if they are not up to standard.
-
Be environmentally aware and limit the time in showers.
-

Hygiene
-
Disinfectant spray and cloth will be provided throughout the gym. Please spray and wipe down your equipment and training area before moving on to the next station.

Respect
-
Please respect our facility, other members, and their experience.
-
6. No Shows / Late Cancellation
-
Sessions MUST be cancelled via the booking app 1 hour prior to the session. If you cannot cancel in advance, please message the facility number to notify the Coach.
7. Cancellation / Termination
-
To cancel your membership, we require 30 days written notice via the cancellation form, which can be requested from the admin team. All memberships are rolling terms that auto-renew unless cancelled 30 days before the auto-renewal date.

BOLT Health and Fitness Pty Ltd reserves the right to terminate your membership if you fail to adhere to any terms and conditions set out by BOLT Health and Fitness Pty Ltd and will appoint a debt recovery service to recover all unpaid fees and associated recovery costs.

The Member may terminate this Agreement before the expiry of the minimum term if all instalments and fees due up to the expiry of the minimum term are paid.

If you terminate the Membership or stop the automatic debit arrangement in a manner not described in the Agreement, then you may be liable to BOLT Health and Fitness Pty Ltd for damages for breach of contract.

If a member terminates a membership agreement because the member has a medical certificate stating that the member cannot use the fitness services supplied under the agreement because of the member’s permanent illness or physical incapacity, the agreement will be cancelled within 48 hours of receiving the medical certificate.

Please note that all programs can be modified accordingly (eg: No upper body if you have a lower limb injury, etc.); therefore, all memberships will be continued unless the medical certificate specifically states the member cannot complete any exercise/modified exercise at all.

Any instalments/fees due at the date of termination (including instalments/fees that fall due during the notice period) will remain a debt owed to and recoverable by BOLT Health and Fitness Pty Ltd. The Member shall only consider that this membership has been terminated at such time as this is confirmed in writing to the member by the payment processing company (not more than 14 days after the termination date).

Termination of this Agreement will also terminate the Direct Debit Request Authority.
8. Cooling-Off Period

By WA Fair Trading (Fitness Industry Code of Practice), all memberships are subject to a 7-day cooling-off period. All payments made are fully refundable, except for those for goods/services received.
9. Pre-Commencement Commitments
-
Members are required to complete and sign all relevant pre-exercise forms and liability waivers before the commencement of any physical activity. Medical advice and/or approval must be sought from a Health Professional where effects of medication and current health may be at risk due to exercise undertaken in a BOLT Health and Fitness Pty Ltd facility.
10. Suspension Policy

Members are entitled to put their weekly fees on hold for up to four (4) weeks total per year at no charge. Any additional time will incur a $15 one-off admin charge per suspension request. All suspensions must be notified via the member suspension form with a minimum of 14 Days' Notice.

Each suspension is calculated in seven-day (weekly) blocks. Membership fees cannot be refunded or credited by the payment processing company if there was insufficient notice.

Suspensions will be lifted and normal payments resumed for all cancellation notice periods.
11. Age
-
The minimum training age is 16. However, BOLT Health and Fitness Pty Ltd may offer specific programs and sessions for children under this age. All minors require prior approval/consent from their parent/guardian before commencing training of any kind.
12. Liability of Property
-
BOLT Health and Fitness Pty Ltd does not take liability for personal property damaged, lost, or stolen while using our facility and services. BOLT Health and Fitness Pty Ltd will hold unaccountable for any property lost or stolen at the facility.

Members and their guests are fully responsible for ensuring their personal items are safely stored within the provided lockers.​
13. Damage and Personal Injury

To the extent permitted by law, BOLT Health and Fitness Pty Ltd excludes any liability to the Member in agreement, tort, statute, or in any other way for any injury, damage, or loss of any kind whatsoever (including, without limitation, any liability for direct, indirect, special, or consequential loss or damage), sustained by the Member and/or any other person, or for any costs, charges, or expenses incurred by the Member, arising from or in connection with this Membership Partnership and/or the services/products provided by BOLT Health and Fitness Pty Ltd and/or any act or omission of BOLT Health and Fitness Pty Ltd.
14. Social Media

By signing this document, you agree that BOLT Health and Fitness Pty Ltd and its partners can use your image in video/photograph format to promote its service offerings externally.

The Gym will not upload, post, or share any media content without the express permission of the Member.
15. Fitness Journey Documentation
-
In return for the support provided, the Gym will document your fitness journey, which may include photos, videos, and other media.
-
This content will be used for promotional purposes across the Gym's website and social media platforms.
16. Member Acknowledgement
-
By signing this document, you acknowledge you agree to abide by the rules of BOLT Health and Fitness Pty Ltd and your membership conditions.
-
You also acknowledge and agree that you are medically capable of undertaking a course of physical exercise and using the facilities at your own risk and responsibility.
-
You are aware that exercise is physically demanding, and participation in some activities may pose a risk to your health.
-
This Agreement also relates to the member’s authority to EziDebit and Integrapay to directly debit the nominated bank account or credit card for any instalments or fees due under the terms and conditions of this Agreement.

By signing below, I acknowledge that I have read, understood, and agree to the terms outlined in this membership agreement, including the month-to-month membership, payment and cancellation terms, and pause policy.
